forelegg - ingen melding (Tourist - english msg!)

Hey everyone,


Thank you in advance for reading my post, and apologies for not writing in Norwegian. I am Dutch and don't speak a word norwegian! :)


 


Anyhow, please allow me to explain the situation. 


While visiting tromso, i got pulled over for speeding by the police. I drove 30km/h too fast, lost my driverslicence, and had to report at the station to sign a forelegg: 2 month suspension from driving and 16 days jail or 7000NOK fine. I wanted to consult a Dutch lawyer and they gave me three days to email ([email protected]) the forelegg back signed and all. This is the last i've heard of it... I mailed them the forelegg and never received anything. My drivers licence came back within 3 weeks via the Dutch officials (not the police), with a letter saying they got my drivers licence mailed and assumed i lost it somewhere. Furthermore there is no record of me speeding in Norway anywhere in the Dutch system.


 


I love, and i really mean, LOVE, Norway, and would like nothing more than to revisit Norway. But I am terrified I am flagged as a fled criminal and will end up going to jail if I ever check in at the airport. I also don't wanna call the Tromso Police and ask whats up, because I might be forgotten and this would stir the pot so to say.


So, long story short, I have one simple question: Is there an expiry date on Norwegian offences? Keep in mind 30km/h is a serious offence in your country. Does anyone know how long it will take for me to no longer have that violation registered to my name? 


 


And I know, if i love Norway so much; pay the fine and i am welcome again. However that fine is more than 2 months of salary for me, so if I can avoid paying that fine it'd mean I'll be able to save that money for my next trip to Norway!

Far as i know it's 10 years until the fine cannot be enforced, that doesn't however mean you won't be in the system for the traffic-offense.   Also, Norway has deals with many of the EU countries for bringing in these fines, or having you extradited by Dutch police to serve your alternative prison sentence in Norway. They have definitely not forgotten, but that doesn't mean they will bother pursuing the case.

I would (if you want to return) contact a Dutch lawyer and get advice, or contact the norwegian police and get it settled.

Thank you for the full explanation! Appreciate the effort! And please let me state I am not proud in any way of my offence. I agreed with the sentencing and if it would've been a reasonable fine I would have gladly paid it; I am guilty. But seeing it is so expensive for me, if i could avoid paying it, it would be better for me. 

 

Unfortunately my Dutch lawyer cannot reach into the Norwegian files. So i might contact a lawyer in tromso to see where i stand on the case! The weird thing is that I have not received anything. Not even a conformation from my forelegg. And seeing how my drivers licence came back from the dutch lost-and-found postal service instead of the police... I think I might have been a headache case for the officer and they let it slip... But a Norwegian lawyer would be able to tell i guess.

Keep in mind 30km/h is a serious offence in your country.

It's quite a bit more serious if the speed limit is 60 km/h or less, in which case getting caught would lead to a suspended license. However, when the speed limit is 70 km/h or higher, your license will not be suspended unless you exceed the speed limit by at least 36 km/h. When you're within the bounds of these license suspending speed thresholds, your violation qualifies for a "forenklet forelegg" rather than a "forelegg". Unlike a forelegg, a "forenklet forelegg" is not technically considered a penal sanction (straffereaksjon) and will not appear on your criminal record (rulleblad). A "forenklet forelegg" lets you choose between paying a certain amount as a fine, or going to jail for a certain time period. Not both.

 

In fact, according to this article there is no mandatory jail time in addition to a fine for any 30 km/h excess of the speed limit. Even when the speed limit is 30 km/h, you don't automatically qualify to a jail sentence unless your speed is measured to 76 km/h or more (i.e. a 46 km/h excess). Are you certain you'd have to pay a fine and go to jail, or would you be able to choose between the two?

That email has a typo in it.

A "forenklet forelegg" lets you choose between paying a certain amount as a fine, or going to jail for a certain time period. Not both.

You cannot choose to either pay a fine or go to jail for a certain time period. In this case it means that 7000 NOK equals 16 days in jail. If you cannot pay, and you don't own anything that can be forcefully sold to get the money, you will go to jail for 16 days. This could also be added to another sentence you have instead of selling something you own. But you cannot simply say "i want to go to jail instead of paying".

 

When you get offered a "forenklet forelegg" you only get the opportunity to say either yes or no to the fine. If you say yes you will have to pay. If you say no, you will get a regular "forelegg", and if you don't accept that either, you will face trial in a court.

When your license get taken by the police in another country because of speeding or other violations, it's sent back to it's origin country. Even if you get it back after 3 weeks it doesn't mean that you can drive in Norway, but you can still use it in other countries.

 

They have not forgotten this. If you don't pay the fine you risk getting wanted in Norway. If you then get stopped by the police or customs they will see that you're wanted, and you will be put in jail to serve your unpayed 16 days. Sucks to be put in jail for your whole vacation.

 

And as many has stated. You got the wrong email adress. I believe you should use: [email protected]
